SECTION – A

Q-1. (a) Briefly explain the concept of the Right of Private Defence.

(b) State provisions of law as to the right of private defence of Body and of Property.

Q-2. (a) When a person may be said to have committed House-Breaking?

(b) What constitutes “Lurking House-Trespass”?

(c) What penalty law provides for lurking House-Trespass or House-Breaking?

Q-3. (a) In what circumstances, issuance of a cheque constitutes an offence? What is the punishment provided for such offence?

(b) What defence, if any, is available to a person accused of issuing a cheque dishonestly?

Q-4. (a) Define “Stolen Property”. State when such property ceases to be stolen property?

(b) When the act of receiving stolen property becomes an offence and what is the punishment provided for such offence?

SECTION – B

Q-5. (a) The place of criminal trial shall be deemed to be an open Court. Briefly explain when may proceedings be held in camera?

(b) State provision of law as to recording of remarks respecting demeanour of a witness when such witness is under examination.

Q-6. Briefly explain who is competent to inquire into the following matters, and in what manner:

  1. a) When information is received that a person has committed suicide.
  2. b) When death occurs of a person while in the Custody of Police.

Q-7. Write Short Notes on the following

  1. a) What is Abetment? b) A proclaimed Offender. c) A cognizable case.

Q-8. Explain law as to how a Magistrate has to deal with a dispute concerning land, which is likely to cause a breach of peace.

Q-9. (a) What is meant by “burden of proof”? On whom lies burden of proof, in a criminal case?

(b) On whom lies the burden of proving that case against an accused falls within an exception?

Q-10. Discuss importance of ‘oral evidence’. What facts may be proved by oral evidence? What is direct oral evidence?

Q-11. (a) What are the methods of proving contents of a document?

(b) Define Primary evidence and Secondary evidence. Distinguish between the two.

Q-12. (a) Which facts are relevant, where the question relates to the existence of any right or custom?

(b) When do the facts which are not otherwise relevant, become relevant?
